1. Introduction
Welcome to Point Guard Eyes. This Terms of Use outline the terms and conditions governing your use of the www.pointguardeyes.com website ("Website") and its services. By accessing or using our Website, you signify your agreement to comply with and be bound by the terms and conditions set forth in this Agreement. If you do not agree with these terms, please refrain from using our Website.
2. Ownership and Intellectual Property
The content, design, layout, appearance, graphics, and other materials on our Website are the property of Point Guard Eyes LLC. Reproduction, distribution, or use of these materials without prior written consent from Point Guard Eyes is prohibited.
3. Permitted Users
3.1 Subscribers are individuals or entities who have purchased a subscription package from Point Guard Eyes. 3.2 Subscribers who are members of an NCAA, NBA, or International professional basketball organization staff may invite up to five (5) fellow staff members to access their account and services provided within their subscribed package. 3.3 Subscribers who are members of the general public shall not share access to their account with other individuals or entities. 3.4 Subscribers shall not share their login credentials with unauthorized individuals or entities. 3.5 Subscribers shall not disseminate analysis or information obtained through Point Guard Eyes to individuals or entities who are not authorized staff members within their account.
4. Subscription Packages and Usage
4.1 Subscribers may choose from different subscription packages based on their roles (e.g., NCAA staff, NBA staff, general public/fan). 4.2 Each subscription package provides access to a specified number of player evaluations from a predetermined, running list of players. 4.3 Subscriptions are valid for a calendar year, commencing from the date of purchase. 4.4 Subscribers can only utilize the specified number of evaluations within their subscription year. Upon expiration, subscribers must wait to renew their subscription to access additional evaluations, unless choosing to upgrade their subscription package. 4.5 Subscribers may have the option to upgrade their subscription to access additional evaluations within the same package for an additional fee.
5. NCAA Approval and Usage
Point Guard Eyes is a scouting service approved in accordance with NCAA bylaws, policies, and procedures. NCAA Division I basketball coaches are permitted to subscribe to this scouting service.
6. Prohibited Activities
6.1 The use of our Website or any information obtained from our Website for illegal or immoral activities is strictly prohibited. 6.2 Unauthorized use of our Website may result in claims for damages and may also constitute a criminal offense.
7. Governing Law and Dispute Resolution
These Terms of Use shall be governed and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
8. Waiver and Severability
8.1 Point Guard Eyes' failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. 8.2 If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
9. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. It is your responsibility to review these terms periodically for changes.
10. Entire Agreement
These Terms constitute the entire agreement between Point Guard Eyes and the user regarding our Website and supersede and replace any prior agreements Point Guard Eyes might have between Point Guard Eyes and the user regarding the Website.
